Terms of Use

Bartter is a platform for placing advertisements. The Portal is not an intermediary for financial operations in exchange or sale/purchase transactions.

The actual purchase/sale transaction takes place between the direct buyer and seller, with both parties mutually agreeing on the most convenient method of delivery and payment for the item.

1. General Provisions

1.1. These terms and conditions (hereinafter referred to as the "Portal") determine the procedure and conditions for using the Bartter portal, and they are binding on all Bartter users.

1.2. Bartter is an advertisement Portal where registered users can create an individual profile to post advertisements. The Portal's operation is maintained and administered by SIA Bartter (hereinafter - Bartter).

1.3. A Bartter user is a natural person who registers on the Bartter Portal.

1.4. Commercial activities are prohibited on the Portal.

1.5. Use of the Portal is considered as each user's full agreement to these terms, including all changes made to them. Bartter has the right to amend and supplement the terms at any time. Such changes take effect after their publication on the Portal.

1.6. The Portal user agrees to receive information from Bartter about various Portal-related updates.

1.7. The Portal reserves the right to use images and other information posted on the portal for promoting the portal and increasing its recognizability.

1.8. To improve content quality, enhance usability, and adapt to user needs, the Portal uses cookies. By using the Portal, the user agrees to the use of cookies.

1.9. The Portal administration does not and cannot assume responsibility for the actions of third parties. The Portal does not assume any responsibility for users' obligations to third parties, information published by users, and goods published in advertisements.

1.10. It is prohibited to place, publish, or send users any advertising, invitations, or calls that offend a person's honor or dignity, incite violence, racial hatred, or any illegal activity. In case of violations, the profile will be blocked.

1.11. If a Portal user's access to the Portal is denied or restricted, or if this user's profile or information in the profile is deleted, then the Portal administration reserves the right not to compensate this user for losses and not to return payments made in connection with paid services used on the Portal. If the Portal administration unilaterally decides to return the funds paid by the user, then the amount available in the user's virtual Wallet is deducted, subtracting the amount of funds (gifts) allocated by the administration, if any.

1.12. The Portal ensures its service availability (SLA) at 99.5%.

The actual exchange or purchase/sale transaction takes place between the direct recipient of the exchange and the exchanger, with both parties mutually agreeing on the most convenient method of delivery and exchange of the item.

2. Registration

2.1. Registration on the Portal is done via social networking sites Facebook.com, Google ID, or email. By registering, the user confirms that they are using their personal social network profile and/or email for registration.

2.2. Only one Portal user profile can be created with one social network profile. If a Portal user closes their Bartter profile, it will remain registered in the database and can be restored. It is not possible to create another new Portal profile with an already used social network profile.

2.3. Multiple social network profiles can be linked to one Portal user profile as authorization tools. When linking them, the email address specified in the profile as the contact email must be indicated.

2.4. By registering, the user confirms that the data provided in the respective user profile is true.

2.5. By registering, the user undertakes to ensure that the publicly available information in the user profile is not rude, mocking, does not contain data of other natural persons, or unsolicited advertising.

2.6. By registering, the user is aware that every registered Portal user is obliged not to disclose their Portal access data to other persons. If actions are performed on the Portal with a registered user's profile using correct authorization access data, it is considered that the actions in the respective profile were performed by the registered user themselves.

2.7. All personal data of registered Portal users are protected in accordance with the laws and regulations of the Republic of Latvia. The processing of this data is carried out in compliance with the general principles of personal data processing established in the laws and regulations of the Republic of Latvia.

2.8. The Portal receives and stores information from the user's internet browser (including IP address and cookies) and information about devices (e.g., device model, operating system, etc.).

2.9. By registering on the Portal and/or using the Portal, the user confirms that they are informed and agree that Bartter has the right to transfer the respective user's data to law enforcement authorities if the Portal receives a corresponding request in accordance with the procedure established in the laws and regulations of the Republic of Latvia.

2.10. By registering, the user agrees that the Portal administration is entitled, at its discretion, including without prior warning, to suspend the profiles of registered Bartter users and/or delete the information contained therein if it does not comply with the terms of use, without assuming any liability in such a case.

2.11. By registering, the user agrees that the Portal administration is entitled, at its discretion, including without prior warning, to restrict the functions of registered Bartter users' profiles if the actions performed in the profile do not comply with the terms of use, without assuming any liability in such a case.

2.12. By registering, the user agrees that the Portal administration is entitled, at its discretion, including without prior warning, to issue a public warning to the profiles of registered Portal users if signs of fraud are detected.

2.13. By registering, the user agrees that the Portal administration is entitled, at its discretion, including without prior warning, to issue a public warning to the profiles of registered Portal users if there are suspicions that its owner is directly related to another profile in which fraudulent activities have been carried out.

2.14. By registering, the user agrees that the Portal administration is entitled to publish the name and surname of the person identified in the profile if it is believed in good faith that this is necessary to prevent or help investigate possible violations, such as fraud. The profile user will be denied the right to correct personal data.

2.15. If signs of fraud are detected in the user's profile and a public warning is applied to it, then this Portal user will not be reimbursed for any losses and payments made in connection with paid services used on the Portal will not be returned.

3. Posting Advertisements

3.1. Publishing an advertisement on the Portal is a paid service.

3.2. A paid advertisement is active for 30 days. After that, it goes into the advertisement history, where it can be renewed for the fee of the respective category advertisement.

3.3. The price of an advertisement depends on the choice of categories to which it will be added. The price of the advertisement is displayed when all basic information has been entered and the section in which it will be added is indicated.

3.4. Publishing an advertisement can be paid for as follows:

  • via the virtual Wallet, which must first be topped up via internet bank or Payment card;

3.5. The prices of services indicated on the Portal include VAT.

3.6. Posting advertisements is allowed for private individuals provided that the advertisements are not related to commercial activity (distribution of goods, provision of services, intermediation, and similar economic activity). Commercial activity is considered to be:

  • systematic trading/exchanging of new goods;
  • systematic exchanging/trading of similar industrially manufactured goods;
  • if the item published in the advertisement is available as an order, in several sizes, colors, variants, copies, etc.;
  • if the item published in the advertisement is exchanged/sold to multiple buyers.

3.7. Changing the content of the advertisement during the publication period is not allowed.

3.8. To highlight their items, users have access to a paid service on the Portal — bumping the item to the top — a specific item is moved to the top of the list in the respective category. The service does not extend the publication time of the advertisement.

3.9. Only one item or service at one price, without additional conditions, can be placed in one advertisement.

3.10. When posting an advertisement, all fields must be filled in correctly to provide an accurate representation of the item or service. The advertisement may only be placed in the appropriate section.

3.11. When posting an advertisement, the approximate price of the item or service must be indicated. The price must be final without any additional conditions.

3.12. When posting an advertisement, at least one photograph must be added. The maximum number of photographs that can be added for one item or service is 4 photographs. The photograph must be of good quality and comply with the content of the advertisement and the Portal's rules.

3.13. During the advertisement publication period, it is offered to replace the published item's photograph with better quality photographs. Consideration of submitted photograph change requests may take up to 24 hours on business days.

3.14. A photograph change is rejected if it is found that the item depicted in the photographs. Or the service is a different product. A photograph change is rejected if it is found that an attempt is being made to change the content of the advertisement.

3.15. If an advertisement is submitted with violations, for example, the first photograph is from the internet, a selfie, a blurry picture, a collage, etc., the Portal administration is entitled, at its discretion, including without prior warning, to move a photograph that complies with the rules to the position of the first photograph and fix it. A fixed photograph cannot be moved to another position or deleted by submitting a photograph change.

3.16. The advertisement must be formatted and submitted in accordance with the rules:

  • the first photograph must show the item or service described in the advertisement text;
  • the first photograph must depict the actual item or service. Photographs must not be from catalogs or found on the internet;
  • in the first photograph of the advertisement, the item must be clearly visible against a neutral background;
  • in the first photograph of the advertisement, the service must be clearly understandable, and the image must unequivocally indicate what the provided service is;
  • photographs with logos of other portals or companies are not allowed to be posted on the Portal;
  • it is not allowed to use photographs with contact information or addresses;
  • it is not allowed to add links to other advertisement, advertising, and internet sites in the advertisement text.

3.17. By posting an advertisement, the user assumes full responsibility for the content of their posted advertisement and the truthfulness of the information.

3.18. Non-compliant advertisements will be moved to the appropriate section, edited, or deactivated, requesting corrections.

3.19. The Portal administration has the right to edit the content of the advertisement, move it, or delete it without explaining the reasons for its actions.

3.20. The Portal has the right to suspend an advertisement without prior warning:

  • if the advertisement does not comply with the advertisement formatting rules;
  • if the advertisement is related to commercial activity;
  • if the advertisement offers to purchase a service;
  • if several justified complaints have been received about the advertisement;
  • if low-quality photographs are added to the advertisement;
  • if important information is omitted in the advertisement, for example, the authenticity of the item, defects, condition of the item, etc.;
  • if more than one item is placed in the advertisement;
  • if unsolicited advertising is included in the advertisement;
  • if medications, dietary supplements, etc., are offered in advertisements;
  • if goods subject to excise duty are offered in advertisements;
  • if smoking devices and their components are offered in advertisements;
  • if weapons, dangerous and harmful substances are offered in advertisements;
  • if goods prohibited for sale are offered in advertisements;
  • if advertisements do not correspond to the theme of the portal;
  • if information is added to the advertisement that the item is being sought with a desire to purchase.

3.21. A suspended advertisement is moved to the archive and can be corrected and resubmitted in accordance with the rules within 90 days from the moment of deactivation. After that, the advertisement is deleted.

3.22. A suspended advertisement can be corrected and resubmitted for review 3 times. If the advertisement is repeatedly submitted with violations several times, it is permanently deactivated.

3.23. Re-examination of suspended submitted advertisements may take up to 48 hours.

3.24. Suspended advertisements that have been resubmitted with corrections and approved may have limited further editing options. The first photograph may be fixed. A fixed photograph cannot be moved to another position or deleted by submitting a photograph change.

3.25. If a user's advertisement is suspended, this Portal user will not be reimbursed for any losses and payments made in connection with paid services used on the Portal will not be returned.

3.26. If a user's advertisement is permanently deactivated, this Portal user will not be reimbursed for any losses and payments made in connection with paid services used on the Portal will not be returned.

4. Transaction Evaluation

4.1. It is possible to leave a review for a transaction concluded on the Portal. Transactions can be rated on a 5-point system, where 1 star is "very bad" and 5 stars are "excellent". Photographs can be added to the review.

4.2. A review can be left 3 days after receiving/sending the application or when the item is marked as sold.

4.3. A review must be left after a real transaction has occurred. Reviews added for a non-occurred transaction may be deleted.

4.4. A review can be added for an initiated but uncompleted transaction if an in-person meeting was arranged, but one of the parties did not show up and did not provide timely warning.

4.5. A negative review must include an_explanation of the transaction and/or item. If there is no explanation, the review may be deleted.

4.6. Negative reviews about a user's promise to exchange an item or service that does not actually happen will be deleted.

4.7. A review containing personal data may be edited (personal data removed) or deleted if this is not possible.

4.8. A review in which the transaction evaluation is expressed in vulgar language may be edited (vulgar language removed) or deleted.

4.9. Reviews added in accordance with the rules are not deleted.

4.10. If a review seems inaccurate, the recipient of the review can add a comment reflecting their account of the situation.

4.11. A review for a concluded transaction can be added within 90 days from the moment the transaction is marked as sold.

4.12. A review can be edited within 30 days after being added.

5. Distance Contract

5.1. These terms (hereinafter – Terms) are a contract between SIA Bartter and the service purchaser (hereinafter – User).

5.2. The Portal is maintained and administered by SIA Bartter, registration No. LV40203613999, legal address: Sigulda, Graudu iela 3, LV-2150, Latvia (hereinafter – Bartter).

5.3. Bartter provides information society services on the portal www.Bartter (hereinafter – Portal).

5.4. The User has the opportunity to receive the services offered on the Portal after the User has agreed to the terms. The price of the service is indicated in its description. All prices are indicated in euros and include value-added tax, unless otherwise stated in the service description.

5.5. The User has the opportunity to pay for the service by choosing one of the remote payment methods offered on the Portal. Bartter provides the User with the opportunity to use the service immediately after payment confirmation, unless otherwise stated in the service description.

5.6. The User does not have the right to use the right of withdrawal as soon as the use of the service has begun, as the distance contract is concluded for the supply of digital content that is not supplied on a durable medium.

5.7. Making payment for the service means the fact of ordering the service and the User's irrevocable consent to the Terms.

5.8. The Terms are not saved but are available before confirming the purchase, and they are also available on the Portal.

5.9. The Terms are binding together with other specified information about the service and other Portal terms of use. These Terms come into force when the User has paid for the service.

5.10. Bartter has the right to amend and supplement the Terms at any time at its discretion. Changes come into force when they are published on the Portal.
